In these Terms, “MyInstaFit”, “we”, “us” and “our” refer to the operator above. “You” and “user” refer to the person accessing or using MyInstaFit.
By creating an account, purchasing a membership or using MyInstaFit, you agree to these Terms.
1. About MyInstaFit
MyInstaFit is a fitness and lifestyle platform designed to help users manage and improve their fitness, activity and lifestyle.
Depending on the features available to you, MyInstaFit may allow you to:
- create and manage fitness goals;
- follow workouts and training programmes;
- record workouts and runs;
- track activity and fitness statistics;
- monitor progress;
- record nutrition and lifestyle information;
- connect compatible health and fitness services;
- work with personal trainers or coaches;
- participate in groups or community features;
- access fitness content and recommendations; and
- receive personalised information based on information you provide.
Features may change, be added or removed as MyInstaFit develops.
2. Fitness and medical disclaimer
MyInstaFit is intended for general fitness, wellbeing and informational purposes.
It is not a medical service, healthcare provider or emergency service.
Information, calculations, scores, recommendations, programmes and insights displayed through MyInstaFit are not medical diagnoses or medical advice.
This includes estimates or calculations relating to matters such as:
- calories;
- BMI;
- body composition;
- fitness level;
- metabolic age;
- running pace;
- training load;
- recovery;
- nutrition;
- exercise performance; and
- similar health or fitness indicators.
You should consult an appropriately qualified healthcare professional before beginning a new exercise or nutrition programme if you have a medical condition, injury, symptoms, concerns about your health, are pregnant, or have been advised to restrict physical activity.
You are responsible for exercising within your own ability.
Stop exercising and seek appropriate medical assistance if you experience unusual pain, dizziness, difficulty breathing, chest pain or other concerning symptoms.
In an emergency, contact the appropriate emergency services.
3. Your account
You must provide accurate and current information when creating an account.
You are responsible for:
- maintaining the confidentiality of your login details;
- activity occurring through your account;
- keeping your email address and account information current; and
- notifying us promptly if you believe your account has been accessed without permission.
You must not create an account using another person’s identity or knowingly provide false information.
We may require additional verification where reasonably necessary to protect your account or the service.
4. Age requirements
Unless we specifically state otherwise, MyInstaFit is intended for users aged 18 and over.
Users under 18 should only use MyInstaFit where the service expressly permits them to do so and with any parental or guardian consent required by applicable law.
5. Monthly memberships
Paid MyInstaFit memberships are offered on a monthly recurring subscription basis, unless expressly stated otherwise at the point of purchase.
The applicable membership price will be displayed before you subscribe.
By purchasing a membership, you authorise the applicable payment provider to charge the membership fee on a recurring monthly basis until the membership is cancelled.
Membership fees may include applicable taxes where required.
6. Automatic renewal
Your membership automatically renews each month unless cancelled in accordance with these Terms.
You are responsible for maintaining a valid payment method.
If payment cannot be collected, we may:
- retry the payment;
- request an alternative payment method;
- temporarily restrict premium features; or
- terminate the membership.
We will not intentionally charge membership fees after your effective cancellation date.
7. Cancelling your membership
You may request cancellation of your membership at any time.
MyInstaFit memberships require 30 days’ notice of cancellation.
Your membership will therefore end on the first applicable renewal date falling after the required 30-day notice period.
For example, where another monthly renewal falls within your 30-day notice period, that payment may still become due and your membership will remain available for the corresponding paid membership period.
After the effective cancellation date:
- no further membership payments will be collected;
- premium membership access will end when your paid membership period expires; and
- your basic MyInstaFit account may remain available unless you separately request account deletion.
Where you subscribed through Apple, Google or another third-party app store or payment platform, you may also need to cancel the subscription through that platform.
Nothing in this cancellation policy limits any statutory cancellation, refund or consumer rights you may have.
Existing UK distance-contract rules provide statutory cancellation rights in various circumstances, including a 14-day cancellation period for many distance contracts. Different rules may apply where digital services or digital content begin during that period.
8. Refunds
Membership payments are generally non-refundable once the relevant membership period has begun, except:
- where required by law;
- where an applicable app store or payment platform requires a refund;
- where we have charged you incorrectly; or
- where we expressly agree otherwise.
We do not normally provide partial refunds for unused days within a membership period after an ordinary cancellation.
This does not affect your statutory consumer rights.
9. Price changes
We may change membership prices from time to time.
Where a price increase affects an existing membership, we will provide reasonable advance notice before the increased price takes effect.
You may cancel your membership if you do not wish to continue at the new price.
10. Personal trainers and coaching
MyInstaFit may provide access to personal trainers, coaches or fitness professionals.
Trainer services are intended to assist with general fitness and exercise.
Unless expressly stated otherwise, a trainer is not acting as your doctor, physiotherapist, dietitian or other healthcare professional.
You remain responsible for determining whether an exercise programme is suitable for you.
Individual trainers may also have professional terms, scheduling rules, cancellation requirements or other conditions which will be made available where applicable.
11. User information and fitness data
To provide MyInstaFit effectively, we may process information that you choose to provide or generate while using the service.
Depending on the features you use, this may include:
- name and contact information;
- account information;
- profile information;
- height and weight;
- fitness goals;
- workouts;
- exercise history;
- runs and distances;
- GPS or route information where enabled;
- steps and movement information;

- nutrition information;
- sleep or recovery information;
- progress measurements;
- body metrics;
- information imported from compatible health or fitness services;
- communications with trainers;
- community activity;
- device and technical information; and
- service usage information.
Some fitness information can constitute health information and special-category personal data under UK data-protection law. Fitness-tracker information can fall within the definition of health data.
12. How we use your information
We use personal information only for legitimate purposes associated with operating and improving MyInstaFit.
This may include using information to:
- create and operate your account;
- provide requested services;
- record workouts and activities;
- calculate statistics and progress;
- personalise your experience;
- recommend relevant workouts or programmes;
- provide coaching features;
- maintain your fitness history;
- synchronise information you choose to connect;

- comply with legal obligations; and
- provide other functionality that you expressly request.
Where special-category information is processed, we will use an appropriate lawful condition for doing so. Explicit consent may be an appropriate condition where sensitive health information is processed to provide a service requested by the user.
13. We do not sell your personal data
MyInstaFit does not sell your personal information.
We do not provide your personal information to advertisers or unrelated third parties for their own direct marketing purposes.
We use user information primarily to provide, maintain, secure and improve the MyInstaFit experience.
14. Service providers
Running an application requires certain specialist service providers.
We may therefore allow carefully selected suppliers to process limited information on our behalf where necessary for services such as:
- cloud hosting;
- database infrastructure;
- authentication;
- payment processing;
- application distribution;
- email and notifications;
- security;
- technical support; and
- service performance.
These organisations act only for legitimate operational purposes and, where required, are subject to contractual data-protection obligations.
This type of processing does not mean that we sell your information.
Our Privacy Policy provides further details.
15. Connected health and fitness services
MyInstaFit may allow you to connect compatible third-party health, fitness or device services.
Connecting such services is optional.
You control whether you authorise these connections, subject to the controls offered by your device or platform.
You may normally disconnect an integration through MyInstaFit, your device settings or the relevant third-party service.
Information imported from connected services will only be used for the purposes described in our Privacy Policy and the permissions presented to you.
16. Data retention and deletion
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including providing the service and meeting applicable legal, accounting, security or regulatory requirements.
Where appropriate, information may instead be anonymised so that it no longer identifies you.
You may request deletion of your account and eligible personal information.
Data-protection law also provides individuals with a right to erasure in certain circumstances, although that right is subject to legal exceptions.
Further information is contained in our Privacy Policy.
17. Your content
You retain ownership of information and content that you create and upload to MyInstaFit.
Where you submit content for features that require it to be displayed, stored, processed or shared with people you select, you grant us a limited licence to host, process, reproduce and display that content only as reasonably necessary to operate the relevant MyInstaFit feature.
This licence ends when the content is deleted, except where retention is legally required or temporary technical backups remain.
18. Community standards
Where MyInstaFit provides community, group, trainer or messaging functionality, users must behave respectfully.
You must not upload, publish or transmit:
- abusive or threatening content;
- discriminatory or hateful material;
- unlawful content;
- harassment;
- sexually explicit material;
- fraudulent or misleading content;
- malware or malicious code;
- spam;
- material that infringes another person’s intellectual-property rights;
- another person’s confidential information without permission; or
- content encouraging dangerous or unlawful behaviour.
We may remove content or restrict accounts where reasonably necessary to protect users or enforce these Terms.
19. Intellectual property
MyInstaFit and its associated software, branding, design, databases, graphics, content, logos, trademarks and technology are owned by us or our licensors.
Except where these Terms expressly permit it, you must not:
- copy;
- reproduce;
- sell;
- redistribute;
- reverse engineer;
- modify;
- scrape;
- commercially exploit; or
- create derivative products from
MyInstaFit without our written permission.
20. Acceptable use
You must not use MyInstaFit:
- unlawfully;
- fraudulently;
- to impersonate another person;
- to gain unauthorised access to another account;
- to interfere with the operation of the service;
- to attempt to defeat security measures;
- to extract data using automated means without permission;
- to distribute malware;
- to abuse trainers, members or staff; or
- for commercial purposes not authorised by us.
21. Availability
We aim to keep MyInstaFit available and reliable but cannot guarantee uninterrupted availability.
The service may occasionally be unavailable because of:
- maintenance;
- updates;
- technical problems;
- network failures;
- third-party services; or
- circumstances outside our reasonable control.
We may modify the service where reasonably necessary for technical, legal, security or product-development reasons.
22. Updates to the application
We may release updates to improve functionality, compatibility, performance or security.
Some functionality may require you to install the latest available version of MyInstaFit.
Older versions may eventually stop being supported.
23. Automated and personalised recommendations
MyInstaFit may use automated systems to analyse information supplied by you and provide personalised fitness insights, recommendations, progress information or suggested content.
Such recommendations are designed to assist you with fitness and lifestyle planning.
They must not be treated as medical advice or diagnosis.
You remain responsible for deciding whether a recommendation is appropriate for you.
24. Third-party services
Certain MyInstaFit functions may depend on third-party operating systems, app stores, health platforms, maps, payment services or other technology.
We are not responsible for services operated independently by third parties.
Their own terms and privacy policies may apply to their services.
25. Suspension and termination
We may suspend or terminate an account where reasonably necessary because:
- these Terms have been seriously or repeatedly breached;
- fraudulent activity is suspected;
- another person’s safety may be at risk;
- the service is being abused;
- payment remains outstanding; or
- suspension is required by law.
Where reasonable, we will provide notice and an opportunity to resolve the issue.
26. Our responsibility to consumers
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes liability for:
- death or personal injury caused by negligence where liability cannot legally be excluded;
- fraud or fraudulent misrepresentation; or
- your statutory consumer rights.
The Consumer Rights Act 2015 contains protections applying to paid digital content supplied to consumers.
Where you use MyInstaFit as a consumer, we are responsible for losses that are a reasonably foreseeable result of our breach of these Terms or failure to exercise reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
MyInstaFit is provided for personal use. We are not responsible for business losses arising from consumer use of the application.
27. Changes to these Terms
We may update these Terms where reasonably necessary because of:
- changes to MyInstaFit;
- new functionality;
- legal or regulatory changes;
- security requirements; or
- changes to our business operations.
Where a material change affects an existing paid membership, we will provide reasonable notice.
The latest version will always be available through MyInstaFit.com.
28. Privacy
Our collection and use of personal information is also governed by our Privacy Policy.
The Privacy Policy should be read together with these Terms.
If you do not agree with the way information is processed, you should not provide optional information or enable optional integrations.
29. Complaints
If you have a concern about MyInstaFit, please contact:
[SUPPORT EMAIL]
We will aim to investigate complaints fairly and within a reasonable period.
Nothing in these Terms prevents you from exercising any rights available under applicable consumer or data-protection law.
30. Governing law
These Terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you retain any mandatory protections available to you under the law applying where you live.
Consumers may bring proceedings in the courts available to them under applicable law.
